  • Paper forms are stored in a locked safe
  • Digital files and audio recordings are stored in an encrypted Microsoft Private Vault
  • Access is restricted to authorised practitioners only
  • Payment details are processed through secure payment providers

How Long We Keep Your Information

  • Clinical records: 7 years after your last session
  • Audio recordings: kept only as long as clinically necessary
  • Financial records: 6 years (legal requirement)

Who We Share Information With

We only share information when:

  • You give clear consent

1. Purpose of This Policy

This policy sets out how Calm Mind Therapy Community CIC (“the CIC”) collects, uses, stores, and protects personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

  • Session audio recordings (where used for clinical accuracy or supervision)

5. How Data Is Stored

Paper Records

  • Stored in a locked safe in a secure office.
  • Access restricted to authorised personnel.

Digital Records

  • Scanned documents and audio recordings stored in Microsoft Private Vault, protected by encryption, MFA, and restricted access.

Payment Information

  • Processed via secure payment systems.
  • Full card details are not stored.

6. Data Retention

  • Adult clinical records: 7 years after last contact
  • Audio recordings: kept only as long as clinically required
  • Financial records: 6 years (HMRC requirement)

Data is securely destroyed after the retention period.

7. Data Sharing

We only share data when:

  • The client gives explicit consent
  • There is a serious risk of harm
  • Required by law
  • Necessary to protect life (e.g., contacting GP or next of kin)

We never sell or share data for marketing.

8. Data Breaches

If a breach occurs, we will:

  • Contain the breach immediately
  • Notify affected individuals where appropriate
  • Report to the ICO within 72 hours if required

We aim to provide a safe, respectful and supportive service. If something has not gone as expected, we want to hear from you. Your feedback helps us improve.

How to Raise a Concern

You can raise a concern informally by speaking with your therapist or contacting us directly.

If you prefer to make a formal complaint, you can do so by:

  • Asking someone to speak on your behalf

What Happens Next

When we receive a complaint, we will:

  1. Acknowledge it within 5 working days
  2. Investigate fairly and sensitively
  3. Respond within 20 working days where possible
  4. Explain any actions we will take

If You Are Not Satisfied

If you feel your concern has not been resolved, you may:

  • Request a review by a Director of the CIC
  • Contact an external body (e.g., ICO for data issues, or relevant professional bodies)

We will provide guidance on the appropriate route if needed.

Terms & Conditions

Terms and conditions Explained

  Calm Mind Therapy Community CIC

These Terms & Conditions set out the agreement between Calm Mind Therapy Community CIC (“we”, “us”, “our”) and clients (“you”). By booking a session with us, you agree to these terms.

Calm Mind Therapy CIC is a community interest, non‑profit organisation providing therapeutic, wellbeing and mental‑health support services in Scotland.

1. Our Services

We provide:

  • Therapeutic support, counselling informed wellbeing sessions, and mental‑health education
  • Delivered by qualified practitioners
  • In person, online, or by telephone

We are not an emergency or crisis service. If you are in immediate danger, please contact emergency services.

2. Booking & Payment

  • All appointments must be booked through our approved booking system (e.g., Acuity).
  • Payment is taken at the time of booking unless otherwise agreed.
  • Concessionary rates may be available for eligible clients.
  • You are responsible for ensuring you book the correct date and time.

3. Cancellation & Refund Policy

3.1 Standard Cancellation Window

  • You may cancel or reschedule your appointment up to 24 hours before the session start time.
  • If you cancel within this window, you may request a refund or transfer the      payment to another session.

3.2 Cancellations Under 24 Hours

  • No refunds are issued for cancellations made within 24 hours of the appointment, except at the manager’s discretion.

This includes:

  • Same‑day cancellations
  • Missed appointments (“no‑shows”)
  • Arriving too late for the session to proceed

3.3 Manager’s Discretion

Refunds or rescheduling within 24 hours may be considered in exceptional circumstances such as:

  • Medical emergencies
  • Bereavement
  • Unforeseen crisis situations

Decisions are final and made on a case‑by‑case basis.

4. Late Arrival

  • If you arrive late, your session will still end at the scheduled time.
  • If you are more than 15 minutes late, the practitioner may not be able to      proceed, and the session will be treated as a missed appointment     (non‑refundable).

5. Client Responsibilities

You agree to:

  • Attend sessions on time
  • Provide accurate information relevant to your wellbeing
  • Engage respectfully with practitioners
  • Not attend sessions under the influence of alcohol or non‑prescribed      substances
  • Inform us of any accessibility needs or adjustments required

We reserve the right to end a session early or decline future sessions if behaviour is unsafe or inappropriate.

6. Practitioner Responsibilities

Our practitioners will:

  • Provide safe, ethical, trauma‑informed support
  • Maintain professional boundaries at all times
  • Work within their competence and professional code
  • Keep accurate and confidential records
  • Explain safeguarding limits to confidentiality
  • Treat all clients with dignity, respect and fairness

7. Confidentiality & Data Protection

We take confidentiality seriously.

Your information is protected under:

  • UK GDPR
  • Data Protection Act 2018
  • Our Privacy Notice (available on our website)

Confidentiality may be broken only when required by law or safeguarding duties, including:

  • Risk of harm to yourself or others
  • Risk to a child or vulnerable adult
  • Serious crime

8. Professional Boundaries

To maintain a safe therapeutic relationship:

  • We do not enter into friendships, social relationships or dual roles  
  • We do not connect with clients on personal social media
  • We do not accept significant gifts
  • We do not provide therapy to friends, family or colleagues

9. Health, Safety & Accessibility

We aim to provide safe, accessible services for all clients.

  • Reasonable adjustments will be offered where possible
  • Lone working and safety procedures are followed by all staff
  • Online sessions require a private, safe space on your side

10. Complaints

If you are unhappy with any aspect of your experience, you may:

  • Speak to your practitioner
  • Contact the Clinical Lead
  • Use  our Complaints Policy (available on our website)

We will respond with transparency, care and professionalism.

11. Limitation of Liability

Calm Mind Therapy CIC is not liable for:

  • Losses arising from your failure to follow guidance
  • Issues caused by internet or technology failures during online sessions
  • Decisions you make outside the therapeutic setting

Nothing in these terms limits liability where it cannot legally be limited.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. The version on our website at the time of booking applies.

13. Governing Law

These Terms & Conditions are governed by the laws of Scotland.
